Any recourse when negligently hit by another bike?

I'm a newbie in this group, so apologies if this question has already been discussed.

The story: this morning on my way to work I was slowly riding my bicycle out of my driveway in Palo Alto, CA, into the street, watching for incoming traffic from the left of the street. When crossing the sidewalk, I've been blindsided from my right by another cyclist (who was, of course, riding on the left sidewalk, relative to his direction). The guy knocked me down and rode over my rear wheel, thus completely ruining it. After which he said that he wasn't going to pay for my wheel, because the collision was not his fault - see, the street doesn't have the bicycle pass, so he can ride where he damn pleases. He did give his name though - Edward Berkowitz from Palo Alto.

So, the question is: do I have any recourse in such cases - perhaps for the future mishaps like this. The ******* has caused a few hundred bucks of damage, and left me literally in the dust. Does anyone have any advise, for this case, or for the future?

TIA,

I am shocked that anyone is left in this world who even knows about this group. It once had some glory days, but things have come to a sorry pass. It is mostly dead now, killed off by trolls and other assorted idiots.

If it is legal to ride a bicycle on the sidewalk, then I think you are out of luck. You should have been looking to see if anyone was coming down the sidewalk as well as the street.

Slow down and look around you when you ride a bicycle. Just be thankful that you were not hurt. I have known of guys getting hit by a bicycle and suffering serious injuries.

If bicycles are permitted on the sidewalk then he is entitled to be there and the collision would probably be adjudged your fault for failing to take proper observation and then moving into his path and causing an accident.

If bicycles are not permitted on the sidewalk then he is at fault and you could take action for losses caused.

I would say this is, in reality, irrelevant because you don't know the speed that the bike was travelling.

Anyone who is affected by a bicycle on a sidewalk should take a cue from hikers on trails who have to constantly dodge cyclists at the risk of their life and limb. Cyclists never have any idea of how they affect anyone else. That is because they are childish and like all children can see no further than the tip of their noses.

Mr. Tom Sherman was a former mainstay of quite a few of these cycling groups on Usenet. He was perhaps its greatest advocate of “post free or die”. However, human nature being what it is, such free forums were impossible as we all eventually discovered. What destroys unmonitored newsgroups are all the “trolls and other assorted idiots” who know no bounds on their free speech.

The one thing Ed Dolan did that Tom Sherman never did was to take on all these idiots and give them a taste of their own medicine. Many a battle was fought and won by yours truly, but the end result was that the newsgroups were destroyed. The silences of the Tom Sherman’s of this world means that the lowest common denominator will always win out as every person with half a brain falls silent. I felt it was far better that a newsgroup cease to exist than that it be dominated by morons and idiots. Tom Sherman was neither a moron nor an idiot, but his silences were always deafening when things got hot. I attributed it to moral cowardice, but it may be that he had a stake in the world and needed to guard his privacy.

It is good riddance to Usenet newsgroups, with or without monitors. They may have served a function when the Internet was new, but have now become nothing but a remembrance of a past festival in which certain individuals gloried in their knowledge of one trivial thing or another. Only the Great Ed Dolan, who is also a Great Saint, remains to kick its dead ass.

Gnaw [1], just that the people on the bicycle newsgroups are generally
civil enough that they do not need telling off. I will and have told
people off when they were being treasonous while hiding behind the
pretense of being politically correct; I have no problems with telling
someone that they are filth who deserves to die if that is really the
case. Or just to go **** themselves, if they are of limited
comprehension. :)

Yes, but only when your ox was being gored. I took on any and all who presented an affront to civility and common sense. I did not limit myself to any parochial interests. I had the interests of the newsgroup as a whole at heart whereas you were notorious for absenting yourself when things got hot. You did nothing to save the group when it was terminal.

Further, the bicycle newsgroups were notorious for being left of center politically and in every other way. You were about as politically correct as they come. It was only your tirade against Israel and the Jews that got you into a bit of trouble. Conservatives on these newsgroups were as rare as diamonds in the rough ... of which I was the exemplar of the type. But of course everyone knows that 1 conservative is the equivalent of 10,000 liberals.
