Interesting if you dissect it..
1. *"The BMW failed to...." * Instead of putting a human face on this
tragedy, they report that a "BMW" - not a person driving a BMW- was involved
in this accident.

I would tend to agree with you.
However, note that was the Officer's report and the journalist was
merely citing it. No freedom of thought of his own to express. Not his
duty, nor his mission.
The Officer himself was in no position to make a better statement. He
only saw the BMW and that stupid little bike.
He could not deny that.
No way for him to make an investigation at the spot, let alone to
speak about responsibilities on either side.
After all, it could had been only the result of a mechanical failure;
if so, the lawyer of the girl driver would easily jump in and sue him,
had he hinted to her responsibility. Nor could he propose the
mechanical failure explanation, either. The BMW would jump in.
Better to keep shut.
Better report as little as possible.

You see, it is the very same culture and attitude that prompted
someone else to write:

I hope this victim's family gets a good lawyer. It's cold comfort,
but it'll at
least make up for the financial part of the loss.

As if one could voice his anger only through a lawyer and expect
justice only through a bank check.
