Any recourse when negligently hit by another bike?
I'm a newbie in this group, so apologies if this question has already been discussed.
The story: this morning on my way to work I was slowly riding my bicycle out of my driveway in Palo Alto, CA, into the street, watching for incoming traffic from the left of the street. When crossing the sidewalk, I've been blindsided from my right by another cyclist (who was, of course, riding on the left sidewalk, relative to his direction). The guy knocked me down and rode over my rear wheel, thus completely ruining it. After which he said that he wasn't going to pay for my wheel, because the collision was not his fault - see, the street doesn't have the bicycle pass, so he can ride where he damn pleases. He did give his name though - Edward Berkowitz from Palo Alto. So, the question is: do I have any recourse in such cases - perhaps for the future mishaps like this. The ******* has caused a few hundred bucks of damage, and left me literally in the dust. Does anyone have any advise, for this case, or for the future? You should have been looking to see if anyone was coming down the sidewalk as well as the street. So, the question is: do I have any recourse in such cases - perhaps for the future mishaps like this. Slow down and look around you when you ride a bicycle. Just be thankful that you were not hurt. I have known of guys getting hit by a bicycle and suffering serious injuries. If bicycles are permitted on the sidewalk then he is entitled to be there and the collision would probably be adjudged your fault for failing to take proper observation and then moving into his path and causing an accident. If bicycles are not permitted on the sidewalk then he is at fault and you could take action for losses caused. |

Anyone who is affected by a bicycle on a sidewalk should take a cue from hikers on trails who have to constantly dodge cyclists at the risk of their life and limb. Cyclists never have any idea of how they affect anyone else. That is because they are childish and like all children can see no further than the tip of their noses. I took on any and all who presented an affront to civility and common sense. I did not limit myself to any parochial interests. I had the interests of the newsgroup as a whole at heart whereas you were notorious for absenting yourself when things got hot. You did nothing to save the group when it was terminal. Further, the bicycle newsgroups were notorious for being left of center politically and in every other way. You were about as politically correct as they come. It was only your tirade against Israel and the Jews that got you into a bit of trouble. Conservatives on these newsgroups were as rare as diamonds in the rough ... of which I was the exemplar of the type.
