Just goes to show that it can be quite dangerous riding counter to the flow of traffic and riding on the sidewalk whilst doing so. I hope both the bicyclist and the trucker are okay. Cheers |

He HAD TO BE APPROACHING when that Truck started to turn out towards the driveway and the trucker missed him completely. What if he were a pedestrian? 3. The Trucker did not stop which is a felony. |

I am not an expert on this specific incident or area but UVC norms allow bicycles on sidewalks in R zoning then prohibit same in commercial zoning. That's not an unreasonable distinction. Motor vehicles have to stop before crossing a sidewalk and this truck did not. I'm reasonably certain it's a traffic infraction not a felony but likely adds another layer to all the various attorneys' arguments about liability. If the truck stops then wonderful, wonderful. If the truck doesn't stop than you may very well be dead. The alternate is, of course, to stop and let the Big Mother cross the sidewalk just as he damn well pleases. Are you serious? Big truck, at some speed, and you cycle right out in front of him, waving your hand.... hoping that he will stop? That is a level of stupidity that is almost unbelievable. I might add that in addition to stating that pedestrians, i.e. those using a sidewalk do have the right of way, the California Highway code also says that "Pedestrians do have a duty to watch out for their own safety, not to cross in a hazardous manner".
