Press release from Crown Prosecution Service
July 29, 2005
HA/2005/0089 DANGEROUS DRIVERS WHO KILLED CYCLIST JAILED Two men who knocked down and killed a cyclist in Hull on her way to work have been sentenced to a total of nine years in prison at Hull Crown Court today (29 July). John Eyre pleaded guilty at an earlier hearing to causing death by dangerous driving, driving while disqualified, using a vehicle without insurance, failing to report an accident and failing to stop after an accident. He was sentenced to five years in prison and given a lifetime driving ban. Michael Chapman was sentenced to four years in prison and was banned from driving for seven years. He admitted causing death by dangerous driving, using a vehicle without insurance, failing to report an accident and failing to stop after an accident. Both accepted that they were racing in a 40 mph zone but denied witness accounts that they were driving at speeds of 70-80 mph. The accident ocurred on Holwell Road at about 9 a.m. on 1 April 2005 while Ann Leung, a Community Participation Officer at Hull City Council and member of the Cyclists' Touring Club, was cycling to work. Eyre and Chapman were racing along Stoneferry Road and Holwell Road when Eyre lost control of his car and hit Miss Leung, throwing her six metres in the air. She died instantly but neither defendant stopped and carried on racing at high speed. Following sentence, Humberside Chief Crown Prosecutor, Nigel Cowgill said: "This was an appalling accident and a clear cut case of dangerous driving. Miss Leung was a responsible cyclist who was wearing reflective and protective clothing as she cycled to work which she did every day. She had every right to expect motorists to respect the rules of the road, especially at that time of day. These defendants showed complete disregard for fellow road users and the CPS welcomes the prison sentences in this case." Two men who knocked down and killed a cyclist in Hull on her way to
work have been sentenced to a total of nine years in prison at Hull Crown Court today (29 July). Is that the maximum sentence then? If not, why not? If (so called) people that kill others and **** off without a care don't get the full sentence then just who does? Cleetus, get the gun, I'll collect some firewood.... bfn, Tony B |

Er No! 10 years for DDD If (so called) people that kill others and **** off without a care don't get the full sentence then just who does? Max sentences are almost never applied and that nice bloke John Eyre will be on the streets again in 4 1/2 years time, but he wont be driving again because of the lifetime ban ........... Oh hang on though, he was already banned when he killed that poor woman ........ |

One wonders what the sentence would have been had Miss Leung *not* been a responsible cyclist, not wearing reflective & protective clothing at 9am in the morning??? Sad, but a possibility of "M'lud, the cyclist was responsible for her owndemise, she was not wearing reflective clothing during hours of daylight."??? helen s |

If not, why not? They almost certainly got credit for pleading guilty. I dunno how much that counts for, though. R. |

I mean, had she not worn a helmet, which would've protected her from being hit by someone doing an alleged 70-80 mph... R. |

Why the **** do they get lesser sentences than Ian Huntley, when they're at least as dangerous to society (if not more so) than him? And being banned already presumably means it's not the first serious offence of a similar nature. -- Not me guv |

One of my colleagues told me that a mate of his was killed during a time trial by a lorry. The driver got off as the cyclist had a black top on!? Now that's justice in action. :-((((((( Andrew helen s |
