It was the cyclist that was guilty of smidsy or just not looking at all, which is common amongst cyclists. |

Doesn't sound like a SMIDSY to me, more like the cyclist pulled out of a side road into the path of a car on the main road (driven by the guy who got done for perverting justice) which clipped him and sent him into the path of a second car, which killed him. Whether either of the drivers was going too fast or not paying attention is not clear from any report of the incident that I've read. |

If that was the case, why did the taxi driver lie about it? There's no point in lying unless you have something to hide. I believe that in any case involving hit & run or perverting the course of justice the burden of proof on dangerous driving (or the "causing death by", or "serious injury by" variants) should be automatically reversed - i.e. if you fled or lied, it is presumed that you were driving dangerously unless you can prove otherwise. If it was blatantly obvious that the driving was dangerous even without that presumption, then it should be raised to "deliberate". I'm sure that would cut down a lot on the prevalence of hit and run offences against cyclists and pedestrians - the driver would HAVE to stop to stand any chance of being presumed innocent. and would the same apply to cyclists that hit and run? |
