If they really can't remember who was driving the car and both were in
it at the time *both* should be punished. That would throw out such a spurious defence and give passengers a little responsibility for their drivers. The deterrent effect would prevent further use of this 'defence'. I'm sure memory would miraculously improve! We were all punished in class when nobody owned up to a misdemeanour.
