If they really can't remember who was driving the car and both were in
it at the time *both* should be punished.

That would throw out such a spurious defence and give passengers a
little responsibility for their drivers.

The deterrent effect would prevent further use of this 'defence'. I'm
sure memory would miraculously improve!

We were all punished in class when nobody owned up to a misdemeanour.
The same should apply in this case...

Whereas police knew exactly who was driving at 100mph on the M5, but
decided not to prosecute.

There's nothing new about this, although it may not be particularly well
known. The courts can only convict an offender, and the camera evidence
doesn't tell you who it was. If the registered keeper refuses to name the
driver that is also an offence, but if the keeper doesn't know who it was
they can't convicted for memory failure, or if there were two possible
drivers and they each refuse to admit it and blame the other (or say that
neither can remember), the court has no powers to convict either of them
because it can't establish who the guilty party is. It is inevitable that
any couple willing to play this game will likely get away with it.

The only thing unusual is that it concerns public figures, if you had to
guess who, the Hamiltons would probably be the first to spring to mind!

He said he had the galloping trots and needed to get to the toilet on
one other occasion - and got let off.
