And the City did not have to pay anything on that either, but you left that
fact out.


That's not what I heard, but I take it you admit that at least two
judges ruled against the city.


Idiotic - bicycle riders can easily stop and carry the bikes to the
side to let an emergency vehicle through. I'm sure nearly everyone in
a critical mass ride would do that to expedite a fire truck or an
ambulance or a police car responding to some sort of emergency or
crime. And if anyone didn't I'd expect the others to have a word with
the dude.


NYC CM did NOT do that during the convention and blocked in two emergency
vehicles for 15 min, who were responding to life threating critical
injuries, that is why the City is ****ed at CM. CM is a bunch of idiots.

Nonsense. Permits are typically required for certain parades and
precessions.


Nonsense, a CM ride is intentionally disruptive, with the point to get
arrested.


We've had these rides in San Francisco for 15 years or more, and they
are not particularly disruptive, and (with the exception of one
incident) people are not getting arrested.

If one person was interfering with the legitimate functions of the
police, by all means arrest him, but if he was merely on the road and
the officer didn't have a siren on, then the officer can wait in
traffic like everyone else, just like he would do if following a car.


Says you. Not the Cops.


Officers will wait in traffic like everyone else unless there is some
emergency, in which case they will use a siren or flashing lights.
The police cannot arrest someone for not being able to read an
officer's mind - the officer has to make his or her intention known.

I've yet to see a driver pull of the road to let a police car by
just because the officer might be in a hurry to reach the nearest
donut shop.

Detective indicted on felony assault as well as DWI in Staten Island
crash that injured two women

A detective praised for his work at Ground Zero was initially charged
with misdemeanor drunken driving and drug possession after an October
crash in which two
women were injured on Staten Island, officials said yesterday.

Five months later, a Staten Island grand jury has indicted Detective
Daniel Massanova, 44, on a long list of charges, including several
felonies and misdemeanor
drug possession and drunken driving, for swerving into oncoming traffic
and slamming into the women's car on Oct. 29, according to court
documents.

Massanova had a blood alcohol level of .11 - way above the legal limit
of .08 - and a bag of drugs, including amphetamines, at the time of
accident, according to court records. He was issued a
desk appearance ticket while he recovered from a broken hip.

Desk appearance tickets are typically issued in minor incidents and
allow a suspect to avoid spending a night in jail.

Jennifer Cornier, 24, and Dawn Alexander, 29, whose car was allegedly
struck by Massanova, are still recovering from what their lawyer called
"life altering injuries."

"It's a horrific tragedy here," said Laurence Tarowsky. "Their injuries
are devastating. They're two young girls whose lives will never be the same."

Part of the delay in upgrading the charges stemmed from Massanova's own
injuries, a police spokesman said.

But once Massanova was released from the hospital, he was not arrested,
instead getting the desk appearance ticket.

When Massanova returned to duty on Dec. 16, he was suspended for 30
days. He is now assigned to desk duty pending the criminal case.

A Staten Island grand jury indicted Massanova Friday on felony charges
of assault, vehicular assault and misdemeanor charges of criminal
possession of a controlled substance and driving
while intoxicated.

Massanova, who could face seven years in jail if convicted of the felony
charges, is scheduled to be arraigned tomorrow.

According to court documents, Massanova, who works in the First Precinct
in TriBeCa, slammed head-on into the car containing Cornier and
Alexander as he tried to pass another vehicle
at Richmond Road and Otis Avenue.

Cornier, who was driving, suffered breaks to her left leg, right foot
and left hand, as well as facial fractures, Tarowsky said. She has
undergone two surgeries for her hand and knee, and still
walks with crutches.

Alexander, mother of a 1 1/2-year-old daughter, underwent three
surgeries to her left hand and wrist.

Massanova was taken to Staten Island University Hospital. There, an
emergency room worker cut open his pant leg and found a bag containing
bottles of Percocet, Xanax and Adderall, an
amphetamine, according to court documents. He did not have a
prescription.



"You know we get together once a month to have this small action
of peace and an alternative lifestyle that gets pretty violently
challenged by the powers of the city," said William Laviano,
whose bike was also seized.


Which it should have as he was blocking a cop car, and screaming at the cop.


Proof that he was?

The NYPD says it confiscated 50 bikes in connection with a law
violation. Police say bikes used in violation of the law will be
taken regardless if any connection to a protest.

ALL property belonging to suspects must be taken away and
accounted for. That includes bikes, wallets, cash, jewelry and other
valuables. You would be the first one to complain if your valuables
were missing.
