Man who killed south London cyclist by careless driving avoids jail
A man has avoided jail after killing a cyclist by careless driving near
Mitcham Common. Nicky Fonkwa Ntopi, 38, of Basildon, was driving a blue Peugeot 307 when he struck 67-year-old John Still on Madeira Road in Streatham. Mr Still, from Lambeth, was taken to hospital in a critical condition but died 11 days after the crash, which took place during afternoon rush hour on April 19 last year. After pleading guilty on Wednesday to causing death by careless or inconsiderate driving, Mr Ntopi was sentenced at Kingston Crown Court to 150 hours of community service. Stop at the scene, plead guilty and say you're sorry - basically get away with murder. Yeah I know, murder involves intent, but really anyone who drives without due care might as well declare "I'm not a bad person, but I just don't care about other road users". |

Do you know the actual circumstances of the crash? Was he driving on the pavement for instance? Would you rather he had driven away (as most cyclists do)? Should he have denied any liability for the crash (as most cyclists do)? (Charlie Alliston for example) What do you think his punishment should be? As it is he has lost his transport (never happens to cyclists, no matter who they kill or maim) He has a two year suspended sentence, the need to take an extra rigorous test if he is to regain his driving licence (cannot happen to a cyclist, no matter what) And a financial penalty (no problem for rich cyclists of course) AND a community service order. What else should he have? |

That's rubbish and you know it. If that could be proven, the charge would be dangerous, rather than careless, driving. Dangerous driving implies some sort of intent or recklessness. Careless driving needs only a moment's inattention or misjudgment and must, of necessity, be unintentional. But hey, since you know better than the police, the CPS and the jury, it's a wonder the state doesn't just hand the whole enforcement of CDBDD and CDBCD over to you. I wonder why they haven't thought of that? |
