Lorry driver who killed cyclist walks free from court with 'ludicrous' £275 fine
A lorry driver who knocked down and killed a father-of-four has walked
free from court with a fine of £275. Kashmir Nahal, 36, pulled out at a busy junction without looking and crushed cyclist Glenn Syder as he rode to work. Nahal admitted a charge of driving without due care and attention and was handed the fine as well as six points on his licence. You can't stop accidents happening, but a bike bumping into a pedestrian is far safer than road traffic vs a cyslist. |

It would appear one was an accident and one was deliberate.- Hide quoted text - Indeed this guy believed with extreme recklessness and his behaviour begs the question as to why he was not charged with manslaughter instead of causing death by dangerous use of a pedal cycle that does not carry a custodial sentence. As regards the other matter, if it could be shown to the satisfaction of a jury that the driver had in fact seen and could have avoided the accident then straight away the offence becomes causing death by dangerous driving and possibly manslaugher. AIUI there is a duty of care on all of us to avoid accidents if at all possible even if we are "in the right". |

Neither was an accident - one was a result of a driver not bothering to look properly, and the other apparently the result of reckless stupidity apportioned between the two parties. |

The other difference is that if there was any reason to believe that the lorry driver had seen the cyclist but borne down on him regardless (which is what the killer cyclist did in the other case), he would certainly have been disqualified from driving and very heavily fined and probably imprisoned as well. |

In fact the law only accepts the notion of complete accident in rare cases such as collapse of a driver, unforseeable mechanical failure and so on. Form thereon it becomes a matter of degree. We all make occasional errors such as missing a traffic sign or failing to check a mirror. Such odd lapses are seen as careless. Where it can be shown that a driver is deliberately flouting traffic regulations and consistantly showing no due regard for other road users then careless driving becomes the more serious dangerous driving and can lead to charges outside Road Traffic law. Take insurance claims. You will invariably be held liable for a collision if you run into the back of somebody regardless of whether they had good cause to slow down or stop. Similarly if a hit a stationary vehicle no matter how badly it was parked your no claim bonus will inevitably the one to go. Similarly reverse into somebody. Makes no difference if they've hemmed you into your parking place so tightly you can't get out easily. |
