German federal court to rule about mandatory cycle ways
The German Federal Administrative Court (Bundesverwaltungsgericht) is
about to rule about fundamental legal questions of mandatory cycleways. The main question is whether the obligation to use them is subject to the so called "sign-forest rule" (which has the purpose of getting rid of unnecessary traffic signs) according to which "bans and restrictions of moving traffic" may only be imposed when a concrete, above-average danger exists. The oral arguments take place on 19 November 2010, the judgement (but not the written reasons) are expected the same afternoon. The federal attorney (Vertreter des Bundesinteresses beim Bundesverwaltungsgericht - representative of the federal public interest) has indicated he agrees with the view of the plaintiff. However, the representative of the public interest of the state of Bavaria has sided with the sued city of Regensburg. Seems to be good times for cyclists in Germany ... Jens P.S.: I'm currently about to win another lawsuit against a nearby city. The have already removed most of the traffic signs by themselves, there is only a ban for cyclists at a railway (streetcar) crossing remaining. |
