I took it to mean that since the crash he had been in hospital, in a
critical condition and had now died. Wonder if he was on a bike with

more literate, more informative and a better use of the pluperfect.

But it is Not-Their-Fault. The amber phase was too short, they were only doing 10%+2mph over the limit, they saw an unlit cyclist wearing dark clothing 200 miles away and had to take evasive action.
