I took it to mean that since the crash he had been in hospital, in a
critical condition and had now died. Wonder if he was on a bike with

Certainly, the sub-headline "He had crashed into a stationary van" is
more literate, more informative and a better use of the pluperfect.

Maybe if we got rid of the notion that motorists have a 'right' to litter public roads with their personal property this would not happen.

lights, another cyclist proceeding across a junction at 90 degrees on a
green light or a brick wall on the dead end of a T-junction - has
absolutely no right to be there, does it?

But it is Not-Their-Fault. The amber phase was too short, they were only doing 10%+2mph over the limit, they saw an unlit cyclist wearing dark clothing 200 miles away and had to take evasive action.
