Assault would be, for example, if he gunned his motor and caused the cyclist to think he was going to hit him, but did not actually leave the stop line. Battery is actual contact. The only reason people are typically charged with "assault and battery" is that they first engage in the assault (for example, shaking your fist in someone's face to threaten them), then they strike them (battery). According to the assistant attorney general from Minnesota (who happened to turn up to a club ride), the legal definition of assault is causing fear in another person that you are imminently going to hurt them, rather than actually hurting them (that is battery). I hadn't known that until then, because of course the term "assault" is commonly used to denote attacking or injuring someone. |

The SUV driver did well to brake at all given the lack of visibility due to the positioning of the cyclist. The driver should be held 100% liable, he should have been paying attention and stopped at the red light or approached with caution if the light had failed. Not. I know that corner.
