One thing the papers rarely report on is the result of the civil suit that (hopefully) follows an outrage like this. Settlements in a wrongful death suit can easily run into seven figures. I hope this victim's family gets a good lawyer. It's cold comfort, but it'll at least make up for the financial part of the loss. And maybe deter the next idiot cager... We lost another one....
“The BMW failed to yield the right of way while turning left and
struck a pedal cyclist attempting to travel eastbound through the intersection,” a statement from the sheriff’s office said. Interesting if you dissect it.. 1. "The BMW failed to...." Instead of putting a human face on this tragedy, they report that a "BMW" - not a person driving a BMW- was involved in this accident. 2. I wonder if, by noting that it was a BMW, they are suggesting that people who drive BMW's are self-absorbed and don't watch the road as attentively as they should -- or if they are, in some sick way, presenting this as a case of an affluent driver (of course she was well-educated and an above average driver if she was driving a Beamer) versus some bum on a bicycle. 3. Note that they soften the actions of the driver by saying "The BMW failed to yield the right of way" instead of saying "The BMW driver blindly made a left turn and mowed down a cyclist." But then, they make the cyclist look like he did something wrong by "attempting to travel eastbound through the intersection," as if traveling eastbound and crossing an intersection are irresponsible behavior on the part of the cyclist. I don't mean to belabor this point or incite a riot, but the way this story was reported is pretty interesting. Granted, it was probably written by a 22 year old startup journalist who didn't give it a second read and never intended it to be analyzed like this. But the way auto/bicycle accidents are reported sets the tone for how people view cyclists, in general. I find that, in many (if not most) cases, these articles are slanted toward the auto driver, usually painting the bicyclist as a crazy, out-of-control cowboy. When people read that kind of stuff, they tend to believe it! |

However, note that was the Officer's report and the journalist was merely citing it. No freedom of thought of his own to express. Not his duty, nor his mission. The Officer himself was in no position to make a better statement. He only saw the BMW and that stupid little bike. He could not deny that. No way for him to make an investigation at the spot, let alone to speak about responsibilities on either side. After all, it could had been only the result of a mechanical failure; if so, the lawyer of the girl driver would easily jump in and sue him, had he hinted to her responsibility. Nor could he propose the mechanical failure explanation, either. The BMW would jump in. Better to keep shut. Better report as little as possible.
