Motor vehicle driver responsibility

If you are riding responsibly in an established bike lane (in the USA) and are injured by a motor vehicle is the driver treated the same as if you were riding on a road without a bike lane? Is the punishment/fine or whatever any different for a driver in such a situation, depending on whether you are in a bike lane, breakdown lane, or just on the side of an unmarked road? Is your protection under the law any different in a bike lane a opposed to being on a road without one? It should not be, but you might want to check your state laws. I'd expect the driver in such a case to be cited for all of the following: 1. Improper lane use 2. Failure to execise due care 3. Failure to recude speed to avoid an accident This, of course, assumes the repsonding police officer gives a damn and actually issues the citations. -- Kristian Zoerhoff |
