Default Morgan Stanley employee gets license to kill cyclists!

Per Duane Hébert:
The one that I posted was some guy driving a pickup that probably fell
asleep with the cruise control on after working a double shift. That
was the speculation. Apparently they can't prove what happened because
there were NO skid marks.


Is that the one where Bob Schwinn was killed?

No it was the one where a truck ran over 6 women cyclist on a flat
straight highway in mid morning. Three were killed. The prosecutor
determined that there was not enough evidence to proceed with ANY charges.

Whether injuring someone with your car amounts to a crime varies
considerably from state to state or province to province. Many
states still do not make it a crime unless the driver was "reckless,"
drunk or known to be incapacitated or under the influence of some
substance or condition at the time of the accident. Hitting someone
because you are looking down at your CD player or spilled coffee in
your lap, or just being "negligent" usually does not amount to a crime
-- and if it does, it is usually a misdemeanor and not a felony
(California, for example).

In that Erzinger case, the guy left the scene -- which is the kiss of
death. In Colorado, it is a felony to drive recklessly and hurt
someone, but reckless is defined as a conscious disregard of a
substantial and unjustifiable risk of injury. It is not just
negligence. But it appears from my cursory review of the statute that
leaving the scene turns even a negligently caused injury in to a
felony. Moral of the story, if you hit someone, man-up and don't
leave the scene. Seems pretty obvious. -- Jay Beattie.

The one here, it wasn't a case of leaving the scene. I think that the
accident woke the driver up. His truck stopped in a ditch or something.
Usually here, if negligence can be proven (like setting your cruise
control and falling asleep) the driver would be charged. Not the same
as drunk driving resulting in death but still something. In this case
they're saying that the lack of skid marks prevents them from seeing
that he was speeding. Since he hit them from behind, the survivors
can't say if he was driving erratic etc. It's just ridiculous given the
situation. Clear day, flat road.
