Default Bloody Hell. Road Rage Motorist excused


By my reading of this, the moron magistrate has told drivers that if a
cyclist annonys you, it's fine to try to knock 'em down.

Some magistrates should be arrested and shot - what a dsckhead!

should not have done what you did."

Hardly. There were faults on both sides, and the magistrate acknowledged
that. A twelve month good behaviour bond seems reasonable, given the
circumstances.

I'm siding with scotty on this one (though maybe not to the same
extreme).

What if this had been an altercation in the street?

2 pedestrians collide because #1's not looking where he's going.
#2 says "watch where you're going, dickhead"
#1 pulls out a baseball bat and threatens #2 with bodily harm.

Are we going to get the same reaction from a magistrate? I don't think
so.

I have no idea what you're on about.

However, I do know that I'm very annoyed that magistrates seem to think
cyclists are expendable (or at least that motorists who threaten our
lives should go unpunished). I am surprised that many cyclists on this
board seem to think the magistrate was right.

Balderdash. Sentencing is about balancing the need for deterring
criminal acts with the desire to rehabilitate/educate the offending
party. A good behaviour bond is a written promise by the offender to be
of good behaviour and not break the law during the period.

If he breaches the bond, he's up for a monetary penalty, and a harsher
penalty than might otherwise have been handed down for the second
offence.

Did he attempt to ram, or was he just intimidating them, with no intent
of actually ramming? Very big difference there.

Let's keep this argument strictly to the merits of the argument, and not
get personal, please. (Counterpoint: honours bachelor of computing,
majoring in computer science. Hardly something that a moron - "a person
having the mental age of 8 to 12 years who is capable of doing routine
work under supervision" - would be able to achieve, would you not agree?)
