The police claimed Harris did nothing wrong before they discovered he
was driving an unroad worthy car.

The police were severely criticised for ****ing this case up and
allowing a killer driver to walk free. Read the reports, in particular
the magistrate's comments and the matter's raised by the dead
cyclists' MP.

Oh what rubbish. It's been rehashed ad infinitum here (on URC at
least); the facts are that he was not found to be at fault in the
deaths of the cyclists - the fine was for something completely

Even though he admitted fault. Just goes to reinforce the point though
about penalties for killing on the road.

A situation that the coroner expressed incredulity at and that has
subsequently been the subject of questions in the House of Commons. Of
course it had nothing to do with the police, who were heavily criticised
in the coroner's report and the evidence they handed over to the Crown
Prosecution Service, having exonerated the driver within hours of the
crash and before any investigations had been completed.

The debate has been whether he should have known it was icy and whether
scraping ice off his car for five minutes before setting out was a
sufficient hint and whether he had any chance with black ice anyway.
Two things have come out of the inquest debate in the House of Commons
that were not reported in the media. The police accident investigation
expert said in Court

"It would have to be accepted that he failed to observe the ambient
temperature display in his vehicle. He set off on his journey having
scraped ice off the window of his car, and subsequently drove through
countryside where visible frost lay....

In my opinion, there was sufficient grip available to the driver to
control the vehicle. Had he driven according to the prevailing road
conditions, as had the vast majority of motorists before this collision,
then I am of the opinion this collision could have been avoided."

When the UK motoring organisation the RAC did checks they found that one
in ten drivers crossed more than THREE SECONDS after the lights had
turned to red and one in five bus drivers. Tranport for London also
found fifty percent more cyclists were killed on green by motorists
running red lights than were killed by running red lights themselves. So
while it is no excuse for running red lights on a bicycle, it is
behaviour by no means unique to cyclists nor much of risk to anyone
other than the cyclists themselves.


Heck, even in the "the hood" where many of the drivers are unlicensed
(but armed) and many of the vehicles and/or their registrations stolen,
running red lights (other than "late yellow") is very rare. These are
the same drivers that drive 20-40 mph over the speed limit, pass to the
right in the bus/bike/parking lane, follow at less than 1/2 vehicle
length, etc. The same is true of the MFFY drivers in the more affluent
areas of Chicagoland, who are very aggressive about violating the
right-of-way of others in their luxury automobiles and SUV's. Is running
red lights actually something that the British are worse about than the
USians?

I have run quite a few red lights after stopping on a bicycle in the
Chicagoland area. However, this is legal since the lights are
"non-functional" for a bicycle due to the loop detectors being set too
insensitively.
