You had omitted more than that!

Yes, the banned driver *is* serving his ban, because driving lays him
open to a penalty to which you and I are not liable. The only way in
which it could be said that the ban was not being served would be in the
situation where it was (judicially) ended prematurely (thus freeing him
to drive lawfully).
