Default Motor vehicle driver responsibility

If you are riding responsibly in an established bike lane (in the USA)
and are injured by a motor vehicle is the driver treated the same as if
you were riding on a road without a bike lane?

Is the punishment/fine or whatever any different for a driver in such a
situation, depending on whether you are in a bike lane, breakdown lane,
or just on the side of an unmarked road?

Is your protection under the law any different in a bike lane a opposed
to being on a road without one?

TIA,

EJ in NJ

Each state has differant laws, but most probably wouldn't draw any
distinction between where you are hit.
