Default Falling off (black ice)

Over the weekend, a friend decided to do his regular 10 mile Saturday bike
ride. Cycling down a lane, he skidded on a patch of black ice and ended up
with a few bruises to his hands and arms as he tried to protect himself.

He's already told the police about the incident and they are now looking
for the driver responsible.

Why was the driver (if any) responsible for the patch of black ice?

Mr Benn's description reads as if the cyclist just fell off by
himself.

Or is this just the typical cyclist's 'killer motorists always
responsible for accidents' response?

Why would they do that ? Drivers who kill or injure cyclists are
usually exempt from prosecution.
