California, got to love it. What is it out there that attracts all these
nuts like MV? All this crap just to create a trail through the forest, (reasonable probability of impact, due to soil stability and erosion, archeological sensitivity, endangered species habitat, hydrology, water quality and proximity to streams, dust generation, traffic and circulation, etc.). I especially like the "archeological sensitivity", read that as "you must keep out, because there just could be an arrowhead lying around somewhere". I'm glad the deer in my area enjoy our single track as much as the bikers do, I had to wait for two to get off the trail this week as they were using it to get between feeding places. In opposing this project, Ms. Alvillar has called me a criminal and has publicly and repeatedly stated that I have caused great environmental damage. Marin County Public Works, Regional Water Quality Control Board and California Fish and Game have viewed this project and do not support Ms. Alvillar's claims about environmental damage. She has also accused me of building unauthorized trails in Marin County, and has spread rumors disparaging my character and accused me of committing illegal acts. Ms. Alvillar targets bicycle advocates in her attacks such as myself and Christopher Lang. I declare under penalty of perjury that the foregoing is true and correct. /s/ James E. Jacobsen" On September 7, 2001, Marin County Public Works wrote a 3-page letter to the owners of Camp Tamarancho regarding "Camp Tamarancho Grading Permit Violation, Grading Permit Application for Hiking/Bicycling Trails" saying, "The Department of Public Works (DPW) and reviewing agencies have examined the application which you submitted to remedy your outstanding grading permit violation and have determined that it is complete. The next step in the process is compliance with the California Environmental Quality Act (CEQA). this is required before a grading permit can be issued...Based on the information on file for the project and field inspections by staff, our Environmental Coordinator has determined pursuant to CEQA Section 15300, that there is a reasonable probability of impact, (due to soil stability and erosion, archeological sensitivity, endangered species habitat, hydrology, water quality and proximity to streams, dust generation, traffic and circulation, etc.). Therefore, the project cannot be exempted from environmental review and will require an Initial Study. Because of the complexity of issues which must be addressed and the unavailability of DPW staff, the Initial Study will need to be prepared by an Environmental Consultant retained by the County at your expense. Should the outcome of the study demonstrate that there are no significant environmental effects which cannot be mitigated, the County will be able to issue a Negative Declaration for your project. You should also be aware that, depending on the outcome of the Initial Study and the facts presented in the environmental review process, a full Environmental Impact Report (EIR) could also be required." Boy Scouts of America, Marin Council, told DPW they wanted to hire their own environmental consultant to do an Initial Study but they have not done so to date. The truth remains that Jacobsen and his cohorts have built 9 miles of illegal trails, having obtained no permits for excavation, tree felling, bridge building, construction in Stream Conservation Areas, destruction of rock outcroppings, etc. Jim Jacobsen has lied under oath. In my defense, Bambi was a pure accidental hit as I was focused on creaming a covey of quail when Bambi just jumped in front of my MTB as I was just cruising along at a reasonable pace of Mach 2. Hey was that you I saw the other day on the trail with spiked tires, a defoliant tank and sprayer rigged under the seat, riding along with a chain saw slashing away at all that unruly habitat? We'll have to get together and ride some time. I've started putting little hashmarks on my downtube to denote all the innocent creatures I've crushed in my years of riding Everyone should do this. Obviously all us MTB'er are out to institute some post-Armageddon like disaster on every inch of wilderness known to man. The downtube hashmarks will allow us to pick out the true veterans among us. Sort of like the old bombers in WWII. You could tell the crew that wreaked the most destruction just by looking at their craft. Double points if someone rides over Mikey V's flower beds..... |
