Default Near Miss of the Day 457: Bristol rider gets punishment pass

QUOTE:
Today's video in our Near Miss of the Day series shows a cyclist being subjected to a punishment pass on a road in Bristol that has long been highlighted as being unsafe for cyclists.

The footage was submitted by road.cc reader Jack, who told us: "This happened on Coronation Road in Bristol, near the ASDA.

"This was the second pass from this driver on that stretch of road - the first was just a 'regular' horribly close pass.

The video contains swearing ... from me.

His response was, 'Use the cycle lane'."

Jack added: "I've reported to it to the police and got the standard reply ... "

Thank you for taking the time to upload your footage which has now been processed (a warning letter or a fixed penalty or a prosecution has been issued). Thank you for helping to keep our roads safe.

Please do not call this a 'Punishment Pass', it is at a minimum Assault With a Deadly Weapon and should always result in a life driving ban and a custodial sentence from 10 years to life.

It's hardly a punishment pass and no harm is done. After the close pass,
the cyclist showed he could have been riding closer to the kerb and
hopefully did so for the rest of his journey.

As far as I can see, the car which overtakes him had to slow down because
the next car in front slows down in the approach to the traffic lights.

The cyclist doesn't notice the brake lights of the first car to overtake
him. Nor doe she notice the brake lights of the two cars in the outer
lane in the distance at 9 seconds -- although his helmet camera gets a
clear view. Why doesn't this cyclist also slow down rather than go so
fast as to almost undertake the slowing car beside him?

He doesn't seem able to read the road properly and then adjust his speed
and position, just as a car driver would. He carries on at speed
regardless of the changing conditions. Does he think a road road full of
traffic is his personal race track?

That he's a risk taker is evident from the high speed he subsequently
travels between the two lanes of stopped cars without any regard to a door
opening.

Yet the police stated:

ENDS
The police obviously agreed with the cyclist and not with you.

Illegal and dangerous door openings are the legal responsibility of the car occupants.

QUOTE:
Rule 239 of the Highway Code states that motorists “MUST ensure you do not hit anyone when you open your door. ... 42 of the Road Traffic Act 1988 makes it an offence to open “any door of a vehicle on a road so as to injure or endanger any person.”

The errant cyclist, who seems to have a history of frivolous complaints,
notes he received no more than a standard letter from the police.

It's the court who determines guilt not the police.

If this case went to court I'm not sure who would be in the dock as the
cyclist's own video shows he failed to read the road properly and nearly
caused an accident by failing to adjust his speed to suit the traffic.
