Default Darren Hall and Mr Turner's death update.

The jailed cyclist, no idea if this is genuine:

Dear readers,

Can i put the record straight about Darren Hall's accident resulting
in Mr Turners unfortunate death. On this day 8th of august 2008 darren
left work as usaull to ride the 4 miles home as he did do everyday but
on this day as darren was riding down littlemoor road towards the
traffic lights, (which was on red) An cars in line waiting, a
inconsiderate motorist, (In a RED car) forced darren on to the
pavement if darren had not done so he could have been hit by the car.
As he was on the pavement he was already breaking as there was a sharp
left hand bend to go round, as he turned the corner he saw Mr Turner
and applied his breaks full on, he did NOT HIT Mr Turner but Mr Turner
was startled, he then moved to the side to get out of the way but
unfortunatly he slipped off the curb which resulted in him hitting his
head.

The reason why darren took this action was because a few months pria
to this darren was riding home from work on the dorchester road when a
car pulled out in front of him from a side street, resulting in darren
hitting the car's front wing an landing on the bonnet, luckly for
darren he was not injured in this accident but mad him very weary of
the traffic on the road and what can happen to cyclists on are roads.

Mr Hall is not an impartial or independent witness so this should be
dismissed as it would be in court. It's not even worth repeating.

Darren Hall submitted the above in evidence as part of his defence.

He could still have stopped, but it's clear the press reports were
partial.

If a driver on a mobile didn't stop in time at a zebra and a startled
pensioner fell and later died despite not actually coming into contact
with the car, should the driver get seven months?

Ah the old 'someone else made me do it' defence! **** off - the riding
on the pavement is _not_ excused by 'an inconsiderate motorist'
(notwithstanding that that smells of bull**** anyway). I think he got
a remarkably light sentence and needs to keep his head down in case
someone appeals its leniency.

So the cyclist was cycling too fast to stop in time when his way was
blocked around the corner. Or he wasn't looking far enough in advance
of where he was going.

Either way, the cyclist was clearly not in proper control.

The driver should get a life ban and some jail time; keeping people in
jail for a long time doesn't serve much purpose unless they are
actively a danger to the community, but a brief sentence is a good
'wake-up' call. So seven months, shortened to three or four with good
behaviour, is probably enough. Actually, one month in prison would
probably enough if the objective is simply to dissuade the offender
from repeat offending.

In your repeated use of this little piece you are accepting the father's
word that there was not contact - that is clearly not what was said and
accepted in court.

Only one report cites a 'collision' implying actual contact.

I take it you have the court proceedings transcript?

It was a hypothetical question, let's assume what Hall snr says is
true.
